3月12日上午，最高人民法院院长周强向十三届全国人大二次会议作最高人民法院工作报告，报告中两次点赞“河南经验”：“推广河南、湖南等地法院经验，依法制裁恶意欠薪行为”“山西、河南、甘肃等地法院开展行政案件集中管辖试点……取得良好效果”。

On the morning of March 12, Zhou Qiang, President of Supreme People’s Court, delivered a work report of the Supreme People’s Court at the Second Session of the 13th National People’s Congress. “Henan Practice” is highly praised in the report, “The practical experience of the courts in Henan and Hunan provinces shall be spread to crack down on malicious arrear of wages by law” and “Courts in Shanxi, Henan and Gansu provinces carried out trials of centralized jurisdiction over administrative cases...with good effects.”

 

记者从河南省高级人民法院了解到，2018年，全省法院共受理拖欠农民工工资案件2.21万件，为3.3万名农民工追回劳动报酬4.2亿元；受理拒不支付劳动报酬犯罪案件96件，已审结95件，95人被依法判处刑罚。

The reporter learned from the High People’s Court of Henan Province that the courts across the province accepted 22.1 thousand cases of arrear of wages for migrant workers in 2018, recovering 420 million yuan for 33 thousand migrant workers; and accepted 96 criminal cases of refusing to pay labor remunerations, 95 of which were concluded, and 95 people were sentenced to criminal punishment according to law.

 

在帮农民工讨薪这件事情上，“河南经验”是怎么做的？据介绍，全省法院畅通涉农民工工资案件绿色通道，坚持快立、快审、快结、快执，优先立案、优先审理、优先执行的“四快三优先”原则，充分保障农民工合法权益。同时，全省法院还对恶意欠薪者果断动用刑罚，依法追究其刑事责任。

How does Henan enact in helping migrant workers get paid? It is reported that the courts across the province opened green channel for cases of arrear of migrant workers’ wages, adhering to the principle of “Four Fasts and Three Priorities” including fast case-filing, fast trial, fast case-closing and fast execution, and gave priorities to case-filing, trial and execution, so as to fully protect the legitimate rights and interests of rural migrant workers. At the same time, the courts across the province also gave administrative penalties to those who defaulted the migrant workers’ wages, and investigated their criminal liabilities by law.

2019年，省高院将适时向立法机关及有关行政机关提出针对性和操作性强的司法建议，合力探索欠薪问题的源头治理办法，加强与公安、检察、住建、劳动保障等相关部门协作配合，进一步加大执行力度，确保有财产可供执行的涉农民工工资案件全部执行到位。

In 2019, Henan People’s Court will put forward targeted and practical judicial suggestions to the legislature and relevant administrative organs to jointly explore the causes of the wage arrears problem, and tightly coordinate and cooperate with the institutions of public security, procuratorate, housing and construction, labor and social security, etc., to further intensify execution and ensure that all the cases concerning the wages of rural migrant workers with property available for execution are fully implemented.

 

集中管辖行政案件，是司法体制改革的重要内容之一，目的是为了改变地方法院审理行政案件时可能受到的地方保护和行政干预。2015年5月，郑州铁路运输两级法院得到最高人民法院批复受理行政案件，河南成为全国首个铁路法院有正式名义受理行政案件且有明确管辖范围的省份。

Centralized jurisdiction over administrative cases is one of the important parts of the judicial reform. It aims to change the local protection and administrative intervention that might be encountered by local courts. In May 2015, the two level courts of Zhengzhou railway transportation were authorized to accept administrative cases by the Supreme People’s Court. Since then, Henan has become the first province in China to have a railway court that officially enjoys the power to accept administrative cases with a specific jurisdiction.

 

在行政公益诉讼案件的审判工作中，河南省也进行了积极探索。2018年，郑州市中级人民法院在基层法院开展行政公益诉讼案件集中管辖试点工作，把黄河流经的巩义市、荥阳市、惠济区、金水区、中牟县的一审行政公益诉讼案件集中由中牟县人民法院管辖。这对于依法加强对黄河流域生态环境的司法保护具有重要意义。

Henan has also positively explored the administrative public interest litigation cases. In 2018, Zhengzhou Intermediate People’s Court carried out the pilot task on the centralized jurisdiction over administrative public interest litigation cases in the local people’s courts, and concentrated the first-instance administrative public interest litigation cases in Gongyi, Xingyang, Huiji District, Jinshui District and zhongmu County, geographically, where the Yellow River flows through, under the jurisdiction of Zhongmu People’s Court. This is of great significance for strengthening the judicial protection of the ecological environment of the Yellow River basin by law.

 

下一步，省高院将在郑州市中院试点的基础上，强化对省内黄河流域沿线、淮河流域沿线、南水北调沿线以及太行山、伏牛山、大别山区等环境资源集中连片区域的环境资源类案件的处理，用司法手段护卫河南的山水田园。（记者周青莎 编译赵汉青 审校焦丹 海报胡瀚泽）

For the next step, based on the pilot of Zhengzhou Intermediate People’s Court, Henan High People’s Court will strengthen the handling of environmental resource cases along the Yellow River basin, Huaihe River basin and South-to-North Water Diversion Project, as well as the Mount Taihang, Funiu, Dabie and other connected areas where the environmental resources are concentrated, in order to protect Henan’s ecological environment by means of jurisdiction.
